Mandatory Detention Avoided

Michael P. Gianelli, Esq., successfully contested the federal government’s argument that his client was subject to mandatory immigration detention because of his misdemeanor and felony criminal record. After oral and written arguments before an immigration judge, the Department of Homeland Security conceded that Mr. Gianelli’s client was incorrectly placed in mandatory detention and was indeed eligible for bond.
